  Introduction
  The Spam Act 2003 (“the Act”) entered into force on 12 December 2004, and represents a legislative response to the growing problem of unsolicited commercial electronic mail. The legislation prohibits the sending of unsolicited commercial electronic messages and also contains rules to regulate the sending of both solicited and unsolicited commercial electronic messages. EDU Technology Solutions Pty Ltd has improved existing practices, policies and procedures, and adopted several new practices, policies and procedures, to ensure that we meet and exceed the standards expected of commercial entities in relation to the sending of unsolicited commercial electronic mail.
   
   
  Commercial Electronic Mail Correspondence
  EDU Technology Solutions has implemented policies, practices and procedures to govern the use of electronic mail in our commercial correspondence.
   
  Policies
 
   
We do not send single or bulk commercial electronic mail messages to recipients who have not expressly or implicitly consented to, or requested an electronic mail communication
   
We identify ourselves personally and our company in all electronic mail correspondence, and include a contact name, our company name, our Australian Business Number, a contact electronic mail address, a contact telephone number and our web site address to enable recipients to effectively contact us regarding the communication, and view our policies, including this policy, published on our web site
   
We have implemented a functional unsubscribe facility, which is subject to any contrary contractual arrangement between ourselves and the electronic mail recipient
   
  Practices and Procedures
 
   
We regularly conduct structured professional development and training to ensure all employees are aware of the current status of the Act and any amendments or standards changes
   
We have imposed a policy requiring that commercial electronic messages may only be sent where there is the necessary express or inferred consent on the part of the recipient
   
We require that all commercial electronic messages sent by or on our behalf by our directors, officers, employees and agents, include the identity and current contact details of the company and the particular person initiating or making the correspondence
   
We require all commercial electronic messages sent by us, our directors, officers and employees contain a functional unsubscribe facility to explain the procedures involved in withdrawing express or inferred consent
   
We systematically honour all withdrawals of consent within five (5) days of notice of withdrawal being given to us, and endeavour to remove the particular recipient’s electronic mail address from any commercial electronic mailing list we may have operating
   
   
  Electronic Mail Address Harvesting Software
  Entities which use, supply or acquire Electronic Mail Address Harvesting software, or electronic address lists obtained by virtue of such software, are in breach of the Act. EDU Technology Solutions Pty Ltd, its directors, officers and employees do not use, supply or acquire Address Harvesting software of any kind, either directly or indirectly. We do not use, supply, purchase or otherwise acquire electronic mail addresses acquired by virtue of any kind of Electronic Mail Address Harvesting software.
   
   
  Electronic Mail Addresses Published on This Site
  Electronic mail addresses published on this site are published for professional or personal communications only and do not constitute an invitation to send unsolicited commercial emails which are not related to the business or person in question. EDU Technology Solutions Pty Ltd, its directors, officers, employees, sub-contractors and other related parties, do not expressly or impliedly consent to receiving unsolicited commercial electronic mail messages. As a consequence, any electronic mail messages received by us that are suspected of contravening the Act may be reported to the relevant authorities, at the Managing Director’s discretion, for further investigation and enforcement. Our policy does not limit any legal rights and remedies which may accrue to us as a result of unsolicited sending of commercial electronic messages to the Company, its Directors, agents or employees.
   
   
  Third Parties
  Our Privacy Policy outlines our stringent policies regarding the disclosure of personal information (including electronic mail addresses) to third parties. We take all measures within our power to ensure that third parties to whom we provide your electronic mail address pursuant to our Privacy Policy, abide by the Act and other relevant Australian legislation. EDU Technology Solutions Pty Ltd does not accept any responsibility or liability arising out of the acts of third parties who may have acquired your electronic mail address through us, pursuant to our Privacy Policy.
